This document is published under Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011 requiring rules, regulations, privacy policy, and Terms of Use for access or usage of domain name https://pearlpharmacy.in/ ("Platform").
1. Platform Ownership
The Platform is owned and operated by Pearl Pharmacy, having its registered pharmacy office at 4th Floor, Plot No. 4138, Dhanashree Complex, Above Platina Heart, Dhantoli, Nagpur, Maharashtra, 440012 (hereinafter referred to as “Platform Owner”, “we”, “us”, “our”).
Your use of the Platform and related medical retail services are governed by these Terms of Use. By mere access or use of the Platform, you contractually agree to be bound by these Terms and incorporated policies.
2. Prescription & Medical Disclaimers
Certain prescription medicines require a valid doctor prescription issued by a registered medical practitioner. Orders for prescription-backed drugs will only be dispatched after verification by our licensed pharmacists.
Content on this Platform regarding salt compositions, side effects, and benefits is for informational purposes only and does not substitute professional medical diagnosis or consultation.
3. General Terms of Usage
To access and use the Services, you agree to provide true, accurate, and complete information during registration or prescription submission. You are responsible for all acts performed through your account credentials.
Neither we nor any third parties provide any warranty or guarantee as to the exact availability, delivery time, or performance suitability of the materials/medicines for specific individual conditions.
All delivered items are strictly governed by our No-Return Policy once dispatched, except in cases where damaged, defective, or expired products are reported within 24 hours of delivery.
Proprietary logos, trademarks, database scripts, and design layouts are licensed to Pearl Pharmacy. Unauthorized reproduction or scraping of content is strictly prohibited.
You agree to pay all charges, delivery fees, and applicable taxes associated with your order as displayed at final checkout or quoted in custom prescription estimates.
You agree not to use the Platform or uploaded files for any purpose that is unlawful, fraudulent, or forbidden under applicable laws of India.
You agree to indemnify and hold harmless Pearl Pharmacy, its directors, employees, and licensed pharmacists from any third-party claims arising out of your breach of these Terms or misuse of medical products.
In no event shall Pearl Pharmacy be liable for indirect, incidental, or consequential damages. Maximum aggregate liability for any claim shall not exceed Rupees One Hundred (₹100) or the order value paid, whichever is lower.
These Terms shall be governed by and construed in accordance with the laws of India. All disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of courts in Nagpur, Maharashtra.
